The owners of Luckygray are currently waiting with baited breath as the connection of He’s Remarkable decide today whether or not to launch an appeal against the protest that lost them the $1 million Railway Stakes in Perth on November 19.

He’s Remarkable originally won the Railway Stakes, however, a protest lodged by Luckygray’s jockey Shaun O’Donnell was upheld and relegated the original winner to second.

Stewards found that He’s Remarkable shifted out on the home turn at Ascot, causing interference with Luckygray, who then went on to finish second by only a long neck.

He’s Remarkable’s trainer Roger James has always insisted that there was no way of telling which horse actually caused the interference.

The decision on whether or not an appeal will be made is expected to be announced around 1pm (AEDT) today.

“A decision will be made later in the day today,” James said.

“We’re waiting until offices open in Perth.

“The owners and myself will make a decision on whether to proceed. I’m meeting them today.”

However, should the connections decide to appeal the decision, they will first have to apply for a leave to appeal.

“What you’ve got to take into account if we do go ahead we need to get a leave to appeal,” James said.

“You can’t just appeal a decision.”

Should an appeal against the decision be successful, the owners of He’s Remarkable stand to gain over $600,000 in prize money and the value a Group 1 win would add to the horse’s stud career.

The trainer said He’s Remarkable was currently enjoying a well-earned spell, none the wiser to the drama that surrounded him.

“He’s out spelling… he’s happy to be out in the paddock,” he said.

Four-year-old He’s Remarkable has been kind to his owners throughout his career, winning five of his 15 starts and close to $290,000 in prize money.
